The testator, John P. Bray, died testate on December 20, 1917, and in paragraph 'Second' of his will, he bequeathed the residue
of his estate, both real and personal, in trust to trustees for the benefit of the wife of testator during her life 'and after
her death to distribute the principal of said trust to my heirs and next of kin in equal shares, except my sister, Mary, to
whom I bequeath two hundred dollars (200)'. At the time of testator's death he was survived by his widow, Winifred Bray (who died October 8, 1948); his sister, Margaret
Flinn; his brother, Neil Bray; his nephew, Cornelius, Dwyer; and his niece, the appellant, Etha Doheny. Cornelius Dwyer and
Etha Doheny were children of Catherine Bray Dwyer, sister of testator who had predeceased him. Mary Bray, who was bequeathed
$200 by paragraph Second of the will, had predeceased testator leaving no issue surviving.
